Overview
Hawaii has not passed supported decision-making legislation, but a new supported decision-making bill is pending. We have not located any case law specifically recognizing supported decision-making, but it may still be required as a less restrictive alternative to guardianship.

- Relating To Supported Decision-making Agreements.
- Hawai’i H.B. 320 Reg. Sess. [legiscan.com/HI/bill/HB320/2025]
- Description: Allows a qualified adult to voluntarily enter into a supported decision making agreement with one or more supporters provided that the agreement does not adversely affect the decision-making authority granted to a court appointed guardian or conservator. The supporter may aide in medical, financial, educational, occupational, and social decisions but may not receive any financial compensation for their support.
- Status: Effective July 3, 2025
- Hawai’i H.B. 1440, 2023 Reg. Sess.
- Description: Adopts the Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act. Repeals the superseded Uniform Guardianship and Protective Proceedings Act.
- Status: House Judiciary & Hawaiian Affairs Committee recommended that the legislation be deferred on February 2, 2023.
- Hawai’i S.B. 1595, 32nd Leg.
- Description: Identifies supported decision-making as a “less restrictive alternative” to guardianship, requiring at least one supporter.
- Status: Read twice and referred to the Committee on Finance as of May 15, 2023.
