South Dakota has not enacted legislation codifying supported decision‑making or pending SDM-related bills. Despite this, SDM is defined in a healthcare context as an auxiliary aid in state law addressing organ donation, but is not recognized in guardianship law. To date, no courts in South Dakota have cited SDM when appointing or terminating guardianships.
