System of Guardianship in Practice in the Republic of Moldova: Human Rights and Vulnerability of Persons Declared Incapacitated

Study conducted to determine whether the practice and arrangement of guardianship provided protection to incapacitated individuals, and whether they complied with Article 12 of the CRPD. Study demonstrated that guardianship authorities are unable to monitor effectively that the rights of the incapacitated are observed, an increase in those who are incapacitated has led to a preference for guardianship, guardianship allows for abuse against the individual.
